I am currently appealing a denial for unemployment benefits in Nevada after being terminated from my job. My employer claimed I was discharged for misconduct, citing that I refused to continue my overdue performance review, was disruptive and hostile towards coworkers, and created a negative work environment. They also stated that I walked out when I was terminated. However, my experience differs significantly. The performance review was overdue by several months, and I had been actively requesting it via email. During the meeting, I did become emotional and stepped away briefly to regain my composure, but I did not quit or abandon my job. I continued to work for over a week after that meeting and even asked my supervisor if my job was in jeopardy, to which I was told to keep coming to work. I firmly deny being hostile or insubordinate. When I initially filed for unemployment, I only submitted a written statement and did not receive a phone interview from the unemployment office before my claim was denied. For my appeal, I have gathered several documents including emails requesting my overdue performance review, my actual performance review, the corrective action and termination paperwork, and a written timeline of events. I am seeking advice on what additional documents I should submit for my appeal. Should I organize everything into a timeline with exhibits? Has anyone successfully appealed a misconduct determination when the employer's account of events was disputed? Any insights from those who have navigated a Nevada unemployment appeal would be greatly appreciated.
