I recently got fired from my job as an insurance agent at a small State Farm agency in Texas, and I'm still processing everything that happened. I had been with the company for two years, and while I had received a warning about being late a while back, I thought I had improved. Unfortunately, I overslept and arrived around 9:40 AM instead of my scheduled 9:00 AM. I immediately apologized to my boss, but he seemed upset and didn't engage with me. He told me that he didn’t think I was ready for the role and that he had to let me go. He asked for my office key and told me to send him my hours, which felt abrupt and left me confused about the exact reason for my termination. Additionally, the day before my firing, he had questioned me about a complaint regarding a smell from a neighboring smoke shop, which I never formally made. I’m unsure if this played a role in my termination or if I'm just overthinking things. I've applied for unemployment benefits but I'm worried about how my employer will respond when contacted. I have a few questions: Am I likely to qualify for unemployment despite being fired for lateness? Does the fact that my last warning was two years ago impact my situation? And does my employer need to prove misconduct for my claim to be denied? I’d appreciate any insights from those familiar with Texas unemployment claims.
