I recently found myself wondering about the legality of layoffs while on leave. Specifically, can a company lay someone off during maternity, paternity, or medical leave? After some research and reading through various opinions, it seems that in the U.S., it is indeed possible for a company to lay off an employee while they are on leave, as long as the layoff is not directly related to the leave itself. I learned that if someone is on FMLA or another type of protected leave, they cannot be laid off because of that leave, but they can still be laid off when they return. I also heard stories from others who have experienced layoffs during maternity leave, which further confirmed that while it might feel unfair, it is legal. It's a tough situation to navigate, especially for those who are already dealing with personal challenges during their leave.
