Now, Texas is saying I'm ineligible for unemployment benefits for a certain number of weeks, based on the severance amount. I'm arguing that according to the Texas Unemployment Act, the severance I received shouldn't count against my eligibility because it was part of a contract signed before my separation date. Specifically, I'm referencing Sec. 207.049 (b), which clarifies what constitutes severance pay. My situation seems to fit the criteria that my severance shouldn't disqualify me from receiving unemployment benefits. I’m looking for feedback on whether my approach seems reasonable as I prepare for the hearing in a few weeks.
