I recently got laid off from my job where I was employed as a [specific role] since May 2023. Upon being let go, I discovered that my former employer failed to inform me about the company's 401k Simple plan, which included a 3% company match after 60 days. We only found out about it in August 2026, well after the eligibility period, when a new hire asked about it. The company claimed they didn't bother to ask us because previous employees declined to participate. After some questioning, we were finally allowed to sign up, but the 401k representative mentioned that it was unlawful to offer the plan to some employees and not others. To 'fix' this, my boss promised to pay us the equivalent of the missed contributions and matching at the end of the year, totaling around $6000. I was okay with that, despite missing out on potential interest. However, when the deductions for the 401k started coming out of my paycheck in September, they were calculated incorrectly, leading to an increase in my federal taxes instead of a decrease. I raised this issue with my boss, but she dismissed my concerns and told me to wait until October to see if it would resolve itself. Unfortunately, I was laid off last week due to economic reasons, and when I asked about the promised $6000, my boss said I wouldn't be receiving it. I’m now left wondering if I have any recourse, especially since I have no written documentation of these promises.
