I recently had a job offer rescinded by a bank in Florida, and I'm trying to understand if the employer violated the Fair Credit Reporting Act (FCRA). Here's what happened: On October 29, I made changes to my business registration at the bank's request, removing myself from my own company as part of the negotiation process. Then, on November 2, I signed a formal employment offer to start the following week and completed the background check authorization through HireRight along with other onboarding paperwork. However, on November 3, during a Teams call, HR informed me that they were rescinding my offer due to collections on my credit report. What struck me as odd was that I received my credit report and the Summary of Rights Under the Fair Credit Reporting Act only after they had already made the decision to rescind my offer. From what I've read, the FCRA requires employers to provide the consumer report and summary of rights before taking any adverse employment action, allowing the applicant a chance to review and respond. I feel that the process was not followed correctly since I was already told the decision was final before receiving those documents. I'm not looking to sue for money, but I am considering addressing this with HR and requesting a compliance review. I would appreciate any insights, especially from those familiar with FCRA requirements in Florida.
