I have a TWC appeal hearing this Sunday regarding my unemployment claim after being let go from my marketing manager position. I was hired earlier this year and unfortunately, I was terminated at just 70 days into my 90-day probation period without any prior warning. I received three weeks of severance pay, but my initial claim for unemployment was denied because my employer had not registered for a Texas unemployment tax account. They rectified that issue the day after my denial. The appeal packet I received states that I was fired for not meeting performance expectations, but interestingly, my ex-employer's own response confirmed that there was no specific incident that led to my termination. I believe I have a strong case because: - I did not receive any written warnings. - There was no performance improvement plan in place. - Their own response indicates that there was no final incident that triggered my firing. - I was paid three weeks of severance. - My employer had issues with compliance regarding their registration with TWC. On the downside, there was a documented check-in meeting where I received some feedback on my performance, but it was not formalized with a warning. I understand that TWC typically requires employers to provide warnings and opportunities for improvement before disqualifying someone from benefits due to performance issues. Since they did not follow this protocol, I’m hopeful for a favorable outcome. Has anyone else experienced something similar? I would appreciate any honest feedback or advice.
